Debt Harassment

Dont' be a victim!

The Fair Debt Collection Practices Act (FDCPA) was passed by the U.S. Congress in 1978 to eliminate debt harassment in the collection of consumer debt. During hearings, Congress found evidence of abusive, deceptive and unfair debt collection by many debt collectors. They further found evidence that these unjust practices lead to marital instability, loss of employment and the invasion of personal privacy.

However, the FDCPA does not cover all collection actions. A creditor that is attempting to collect on its own overdue accounts is not subject to the rulings of the FDCPA. The law defines a debt collector as someone who is in the business of collecting debts, which does not apply to a retail store or credit card company, for example. In-house collections are covered by the FDCPA if they knowingly give the impression that they are a debt collection agency. Even if a bill collector is not covered by the FDCPA, they may still be subject to enforcement by other provisions under the Fair Trade Commission Act (FTCA).

Over half of the states have laws that govern the actions of bill collectors and are meant to stop or curtail debt harassment (often misspelled as harassment). Some state laws even provide additional protection not found in the federal guidelines.
